This video is a response to a thread/video over at GBATemp. I finally got a 3DS of my own and can confidently say it doesn't have a issue with the hinge.

It will have a bit of give to it if you move it with your hands or shake it hard enough, but again, this wasn't designed to be launched into space or used in the military, so as a result the hinge won't be super tight. The top screen has more stuff in it then the old DS Lite had, so for the same quality parts, don't expect the same result. Unless you would pay an extra 100 dollers or so just to have a console with a super strong hinge. :P
