Please note that under section 512(f) of the Copyright Act, any person(s) who knowingly materially misrepresents that material was disabled due to mistake, misidentification or misrepresentations (fraudulent or false copyright claims) may be liable for damages.
In other words, "any person who sends a Notice Of Claimed Infringement ("NOCI") [to an online service provider] with knowledge that claims of infringement are false may be liable for damages." Online Policy Group v. Diebold, Inc., 337 F. Supp. 2d 1195, 1202 (N.D. Cal. 2004).
