The gun will CHANGE from lethal to non-lethal fire mode (and opposite) after you peformed 50 kills / "takedowns" with it FOREVER. So select the OPPOSITE of what you'd want it to be forever while acquiring it. And if you haven't, just load for a save file before getting the gun.

You can RETURN the gun to its original owner REGINA JONES, the FIXER located in KABUKI, WATSON for a tiny amount of eddies & XP. Not worth it in my opinion.
