12:01 Again... he is wrong... he can always use the power of that sword if he has 1 energy to spend because he can retire a card from the Deck

13:03 He has no choice... if a card that's played to move or to fight has a special power the player MUST activate it (unless the card says "MAY" which is not the case here)...
So Richard had to draw a card... and again, he's wrong about the Cursed Sword because it can retire cards from the Deck too
