The patent that EA holds essentially equates to a malleable method by which they can manipulate, incentivize, punish, and strongarm their player base, all beneath the surface while the users are unaware.
I cannot say for certain to what degree... if any... they might have implemented it within major titles but the framework is there, and regardless of how recurrent spending end sup impacting difficulty, the fact that it is even tied to a dynamic adjustment of actual game mechanics at all... is entirely unacceptable.
