This works because killing somebody under the effects of frenzy counts as self defense. Casting a frenzy spell on somebody or attacking them with a frenzy poison would normally count as assault, so you would get a 40 gold bounty for the kill. Doing it with a cinematic kill applies the poison instantly and you won't even get an assault bounty at all.
