Wait... shouldn't Loot Boxes be illegal?
I know the ESRB discredited explanations like mine as being "not gambling" because you always get at least something out of each roll. For example, if you buy Pokemon Cards from your local convenience store, sure you may get a pack of duplicates but at least you're getting something by chance, legally.
*HOWEVER!*
Physical rewards like Pokemon cards can be traded, sold, etc. Loot box items cannot (with the exception of Black Ops 3's "Burn Duplicates" but you still don't get a hell of a lot of value for this)
So in my opinion, this is still way too sketchy and should still be considered gambling, thus illegal.
