A wrong thing doesn't do anything (active) - it has to be done (passive).
to have + v3 👉 active perfect infinitive.
to have been + v3 👉 passive perfect infinitive.

The perfect form of a non-finite verb (whether the infinitive, the gerund or the participle) names an action/state ('done' here) completed before the action/state denoted by the main verb (finite verb - 'was' herr) in a sentence.
