We filed a police report and gave them pictures of the user's 3DS friend card and normal Pokemon X profile, sadly without the offending profile picture it may not get past the state attorney. We did contact Nintendo at 1-855-548-4693 and escalated a ticket from their account support. We gave them the Nintendo IDs of my daughter and the offending user. Hope to hear more in the next couple of weeks.
