Sony Beats the GOVERNMENT - PS5 Lawsuit Update

Sony has successfully won a patent infringement lawsuit in which it was being sued for $500 million for its controller-to-console communication method.
The lawsuit was initially filed against Sony in 2017 by Genuine Enabling Technology (GET), which claimed that Sony had infringed on its patent in the way its controllers and consoles connect to one another.
However, as reported by GamesIndustry.biz, a US District Court judge has now ruled in Sonyâs favour, deciding it didnât infringe on the patent.
One of the main complaints in GETâs suit was that PlayStation consoles and controllers submit a âslow-varyingâ frequency signal for button inputs, and a higher frequency signal for motion controls.
According to GET, no device was able to receive both signals at the same time until its patent provided the solution.
Sonyâs argument was that GET had failed to prove that a specific component in its controllers was âstructurally equivalentâ to the diagrams in GETâs patent.
The judge agreed and, saying that GET had âfailed to raise a dispute of factâ, found in Sonyâs favour, ruling that it hadnât infringed on the patent and that the case was now closed.
As GI.biz points out, GET still has a similar lawsuit ongoing against Nintendo. This suit was also found in Nintendoâs favour in 2020 but the decision was reversed in 2022 by the US Court of Appeals and is still ongoing.

There have been two big stories on the ground at GDC this year: Xboxâs flatlining brand and the purpose of the PS5 Pro. Speaking as part of a podcast, GamesIndustry.bizâs well-connected reporter Christopher Dring noted that he didnât meet a âsingle personâ at the show that understood the point of Sonyâs mid-gen upgrade, which is rumoured to release later this year.
He clarified that he expects âPS5 fansâ to upgrade, and thus there are inherent advantages for Sony. But games makers are struggling to get excited about the system. âDevelopers donât really seem to feel they need it, at least the ones I spoke to,â he revealed. âMany feel theyâre not really making the most out of the PS5 in the first place.â
Due to the aftermath of the pandemic and extremely long development cycles, weâve not really seen a huge number of tentpole PS5 exclusives yet. âA couple of companies said this isnât going to grow the market â itâs not going to move the needle,â Dring shrugged. âThis generation doesnât even seem to have got started really, let alone feel the need for a mid-generation update. How about we just get some original, next-generation software up and spinning?â
The journalist later clarified that he imagines Sony has reasonable expectations for the refresh, and the company knows itâs probably going to have niche overall appeal. As weâve reported previously, innovative new features like PlayStation Spectral Resolution likely exist to improve the capacity of Performance Modes in titles like Final Fantasy 7 Rebirth. Therefore, if that sort of thing appeals to you, you probably belong to the small segment of the market PlayStation is targeting.

Some third-party publishers are reportedly expressing doubts about continuing to support Xbox consoles amid âflatliningâ sales in Europe.
Thatâs according to GamesIndustry.biz head Chris Dring, who said his takeaway from GDC last week was that he thinks âXbox is in real trouble as a hardware manufacturerâ.
âThe other thing I heardâI heard it from a very prominent company and one not so prominentâwas Xboxâs performance in Europe is just flatliningâ, he said.
