A couple of brothers think there video's are unique enough to be protected legally. I wish them well. However, reaction videos are not unique and we have seen them on platforms, including TV, radio, films, books, etc for more than the 12 years they have been producing content.
Britain's/America's got Talent or X Factor? Unique, and the first, yes. That doesn't get The Voice from being sued, which many could argue are similar enough in format, just not in style.
The only difference is that it's just way too easy to take down a video even if you don't have any legal course of action to do so. The groups and individuals with this power abuse it to their own needs, as witnessed by the YouTube community for the last several year. It's not entirely YouTube's fault, they got pressured in to this. If we want change, the impossible needs to happen.
Stop watching YouTube. Don't click on links for Ad Revenue. Stop using anything to do with Google? YouTube content creators need to take their talent somewhere else where they do not live in fear of DMCA takedown, especially without evidence of infringement, just for saying a single wrong word. Then have to wait for at least a month for any recourse, which again is controlled by the initiator in the first place.
Time to get a steady job to help pay those bills if you are frequently worried your Ad Revenue is not enough to live on next month. Plenty of Salt to rub in the wound there but it's a choice that you, the reader, are free to make up your own mind and choose the right action for you. Unless you are mega loaded and can afford a good lawyer to fight your good fight, then you can form a monopoly and take down smaller channels to become the very thing you hated the most. Isn't that cliché? In fact all those video's out there make it cliché. That alone is grounds for defence.
In conclusion, it's time to update the DMCA legislation; anyone who abuses it, gets taken down! Legally, of course, and as quickly as it can be done to any YouTube video out there. The YouTube police need to be drafted "to watch and protect all".
And finally, here is my reaction which does not 'plagiarise' their format. Nor is it similar in style. As far as I am aware, this is a truly unique video (OK, I give in, it was inspired by a certain Rick Roll video. I hope I don't get DMCA'd by that guy, or whomever first came up with such a simple idea that 1 in 100 probably have). My hope is to inspire an intelligent and constructive debate over this subject.
No offence is intended. Especially to the fans of these Bros. If you take this as an offence, that is your choice.
