After the new Casino DLC update Rockstar has made some significant changes to passive mode.

People won't be able to go into passive mode if they are in any form of weaponized vehicles. Also after killing someone off can't go into passive mode for a couple of minutes.

I would say these are some very well thought of changes and were being requested by a lot of people anyway.
