A plaintiff from San Diego, Lawrence Klein, is suing Microsoft over its decision to end free support for Windows 10 in October. The lawsuit claims that Microsoft is attempting to monopolize the generative AI market by forcing users to buy new devices to run Windows 11. Klein argues that this strategy ensures a large user base for Microsoft's AI software, such as Copilot.

The complaint highlights the risks associated with discontinuing Windows 10 support. With millions of users expected to not upgrade or pay for extended support, their devices, including those of businesses with sensitive data, will be at a heightened risk of cyberattacks. As of April two thousand twenty-five, Windows ten still accounted for approximately fifty-two point ninety-four percent of all Windows users. The plaintiff alleges that Microsoft is forcing a transition in just four years, which is historically much shorter than previous Windows release cycles.

The lawsuit estimates that two hundred forty million or more devices will become obsolete because they do not meet Windows eleven's hardware requirements. Klein's complaint argues that forcing people to discard these functional devices to buy new ones creates a massive amount of e-waste. He describes Microsoft's campaign as an effort to push consumers toward "Copilot+ PCs" and their AI software.

Klein is asking the court to compel Microsoft to end misleading advertising, clearly disclose the risks of discontinuing Windows ten, and be transparent about alternative security options. He requests that Microsoft be required to continue providing free Windows ten updates until its user share drops below ten percent of all Windows users. Klein is only seeking attorney's fees for himself.
