Even if you knock Merces's HP to 0, he'll survive and run away. Efreet is weak to ice and shouldn't be too hard if you specced Ark as a mage.
Afterwards, you'll still have a few battles in the castle due to the surviving guards getting brainwashed. Even their captain can't get them to stop attacking. Oh, and Merces succeeds in killing the king of Charn and the party gets framed as the assassins.
