On July 7, 1797, Napoleon published the constitution of the new Cisalpine Republic, which included Milan as its capital and several other Italian territories. The constitution, based on that of France, was drafted under Napoleon's direction. He appointed the Directors and legislators himself to ensure a favorable government composition. The creation of this republic was a significant step toward fostering an Italian national identity and served Napoleon's strategic interests by providing a unified Italian state as a buffer against Austrian aggression.

In Paris, the political situation became precarious. General Hoche's appointment as war minister, despite being under the minimum age requirement, led to accusations of violating the constitution, forcing his resignation. Napoleon, who was also below the age requirement, perceived a threat to the republic and expressed his concerns to the Directory. Political deadlock ensued as the separation of powers between the Directory and the Assembly hindered effective governance.
