Once you obtain the Obsidian Sword, your character tells the "Red Mage" in no unclear terms. You cannot have the Fatestone. However, you are actually given an option to just fork it over, and to my surprise, there actually is a voiced over dialog for this.

Furthermore, it is noteworthy that you can simply avoid the battle against Spite by discarding the Fatestone. It's funny how this also applies to the Black Diamond, for example. The mermaid tells you that you came back with the Fatestone no less, and yet the Minion never shows up and the scene plays out without that part.
