UMG Copyright Claim
In this video I prove that UMG have made a false copyright claim on videos that contain a song that I own and control the publishing and audio copyrights on.
The song in question is Insanity by Oceanic.
This is a song by a band that I used to be in during the start of the 90s. As a member of the band I co-wrote the song but I also recorded, mixed and produced it and would subsequently re-record it in accordance with termination of various agreements and licensing arrangements as and when they expired or in events of rights reversals.
It is also important to point out that as the studio owner and producer for every version of Insanity that had been recorded and having covered the costs of the recordings through the commercial use of my studio, equipment and my personal time as recording engineer, mix engineer and producer. This made me the sole and legal owner of all the audio masters and consequently their copyright owner, until such times that I would enter into a license agreement with a 3rd party for my audio copyrights.
The very first version of this song was assigned to Dead Dead Good records (DDG) for its audio content and the publisher at the time was Warner Chappell.
After the original recording and publishing agreements for this first version of Insanity expired, I then made various re-recordings of the song. Subsequent re-recordings would be as close to the first DDG recording as possible but would be technically and sonically improved. This would also appease any re-recording terms wherever applicable.
The version of the recording that Universal Music Group are laying claim to with regard the audio copyright, was originally a limited license agreement between myself as the licensor, with myself and my friend, co-writer and singer, Jorinde, as the recording artists, Oceanic, and All Around The Word Records/Limited (AATW) as the licensing record company, the licensee.
The version that UMG are contending was one of the mixes licensed to AATW, Insanity (Dream Tripper Old Skool Club Mix)
AATW had an agreement for distribution and marketing with Universal Music at the time. AATW became insolvent, which then passed all of their remaining licenses and copyrights over to Universal Music, triggered by a typical insolvency clause that's common in such record label management, distribution & marketing agreements. What UMG received in this arrangement was the remainder of any license terms outstanding on any of AATW's licenses with their licensors, me being one of them with Insanity (Dream Tripper Old Skool Club Mix)
At this point UMG were accountable directly to me with regard any and all audio royalties from the license with AATW. Something that they never completely fulfilled as they never adhered to the original terms of the deal between myself and AATW. This license was finite and expired a few years ago, with the audio rights reverting back to me.
So, at this point I actually own Insanity (Dream Tripper Old Skool Club Mix). Something that UMG are either unaware of, or simply ignoring. In any event I've not contested the point due to the impracticality of taking on a major and the legal fees involved and they still account to me for partial royalties.
At this point I also own Insanity Dream Tripper Mix, due to a rights reversal from a different recording/licensing term with a different record label.
Insanity Dream Tripper Mix was never a part of the AATW deal and so therefore can not possibly be associated with UMG in any way.
So now we're all clear and up to date, I can now prove unequivocally that UMG have made a false copyright claim to YouTube Google against me and the audio copyrights I own.
As is clearly heard between the two examples in this video, Insanity Dream Tripper Mix and Insanity (Dream Tripper Old Skool Club Mix), they are both different recordings.
Even if UMG were to be the legal copyright owner of Insanity (Dream Tripper Old Skool Club Mix), which they aren't but for the sake of argument let's say they are. This has been proven to be a different recording to the one they are claiming is a breach of copyright, Insanity Dream Tripper Mix.
Once again, this is absolute proof that not only have UMG made an illegal copyright claim for a copyright that they do not own. It also makes YouTube and Google culpable to the illegal claim of a copyright, as it's YouTube Google who have allowed Universal Music Group the mechanism to make and enforce such an illegal claim.
