Will This Pre-owned Switch Game Get My Switch 2 BANNED? We Call NINTENDO!
I recently discovered a problem in my game room. I couldn't find my copy of Super Smash Bros Ultimate for the Switch. I tore my game room apart, looked around, under, and behind everything, and it wasn't to be found. I looked through my sales records over the last 18 months, and I didn't sell it. Not knowing where it could be, and needing a copy to test lag and latency when reviewing controllers, I traded a few games for a pre-owned copy at the recent Utah Retro Gaming Expo. My concern, albeit slight, was the report that used games were causing Nintendo Switch 2 Systems to be banned from accessing Online services. Will this pre-owned original Switch game get my Switch 2 banned? Well I decided to call Nintendo while testing it, that way if there was an issue, I could have them address it right away.
The Issue:
This all stems from the MiG Switch and the Unlock Switch backup cartridges. Each Nintendo Switch cartridge has a digital thumbprint to it, so that way Nintendo servers can tell precisely which copy is being used on which system at any time. The problem occurs if both a backup and an original copy are being played at the exact same time. Nintendo flags that as one of the two cartridges being a backup or copy, and as such BOTH users get banned from Nintendo's servers!
Nintendo, incorrectly, interprets copyright laws where backups are concerned here. At least in the USA, you are legally allowed to make a backup of your games, however, they believe that only one occurance of a piece of software can be in use and active at any one time. The law does not address that, and Nintendo's ToS for the Switch 2 gives them authorization to ban systems and accounts they believe have circumvented copyright.
Some people have reported that Nintendo will Brick your system if you use MiG Switch, but this is a misrepresentation of what happens. The system isn't bricked, but it is blocked from accessing online content and online multiplayer games. But you can still use it offline.
At least for me, this copy did not cause any issues. Moving forward, however, I don't plan on using this game in my Switch 2. I don't think it is worth the risk to me, and honestly I may trade this copy in to my local GameStop for a new, sealed copy.
