Legal challenge to new HOS? | Sunday Rant | Trucking Answers
The FMCSA recently announced new hours of service rules that will go into effect in the fall. Already groups are coming out against them. First off is CRASH. Citizens for safe and reliable highways has said that these new rules will do nothing to increase road safety. I agree. The more you work, the more tired you are. By having drivers work more, they are more tired. The split sleeper rules will just encourage drivers to continue when they are tired and companies will try to force you to drive because you still have hours available. When you refuse, you may sit a day or two to learn a lesson. This way trucking companies can say they never forget people to drive tired. The other group opposed to the new HOS is the Teamsters. They are saying the hours increase the time drivers could work but not increase safety in any way. Of course, the new HOS will decrease driver pay because you will be encouraged to split sleeper while loading but that time, for many, is unpaid. Although Teamsters likely get paid for this time, many drivers volunteer to sit for free. Working more is never the solution to making more. No one has yet addressed companies, usually ATA, allowing drivers to work without pay.
