Video Games No Longer Under "Fair Use"? - Where's The Fair Use? #WTFU
As a gamer and content creator who tries to comply with copyright law as best as possible, I'd like to respond to the Nostalgia Critic's video entitled "Where's The Fair Use?" and provide some insight on the Video Game Industry's move away from Fair Use Rationales to the more accommodating Game Developer Video Policies.
YouTube's copyright system definitely has problems and it needs to be explained and put in the spotlight, but video game content creators on YouTube can avoid it in most cases thanks to developers allowing their content to be recorded and monetized on YouTube. Fair Use on YouTube is no longer required. While gamers on YouTube still receive unfair takedown notices and malicious developer and publishers continue to file unjust DMCA claims, there's a much lower risk overall in creating video gaming content, such as Let's Plays, reviews and machinima.
